One of the biggest debates between the public and the recorded music industry is whether or not creating backup copies of personal CDs and DVDs is legal. Manufacturers state that making copies for any purpose is illegal because to do so is a copyright infringement, but the public is in favor of the Fair Use Act and the Audio Home Recording Act of 1992. These are open to interpretation, but in a nutshell – you may legally make a copy of your CD for personal backup if you were the one who bought (and still own) the original. . . Audio Home Recording Act of 1992.The Audio Home Recording Act of 1992 states that copyright holders can't sue the average user for making home copies of their music. But the studios' lawyers say that the recording companies are not required to make available the technology to do so – that means the recording industry will try to make their disks as challenging as possible to copy. Objections from the movie industry are due to a common feature in DVD copying software decryption of the content scrambling system (CSS). DVD movies are coded with CSS to prevent copying and the decryption technology allows the DVD to be copied through bypassing the CSS protection. The court’s justification came from the fourth item in section 107 of Title 17 of the U.S. Code, which gives as a consideration for infringement the following: ”the effect of the use upon the potential market for or value of the copyrighted work.” This means that if the copy or duplication of the copyrighted work does not decrease the market value, then it is not a copyright infringement. Essentially, if a copyrighted work is broadcast on public airways, copying it for personal convenience is legal. Based on the fair use ruling, DVD copying supporters strongly feel that if an individual has purchased a CD or DVD there should be no justification for prohibiting him or her from copying the CD or DVD as long as he or she does not distribute copies

Using a CD burner is more cost efficient, but the quality suffers as a result

The CSS (Content Scrambling System) is the encryption method used in commercial DVD production to prevent DVD data from being copied. The sole purpose of the CSS is to protect copyrights by preventing the pirating of DVDs.
. .. The CSS decryption, called DeCSS (De-Content Scrambling System) is an algorithm that can be used to decrypt a commercially-produced DVD, allowing it to be unlocked then copied. In January, 2000, the development of DeCSS was blamed on Jon Johansen, a fifteen year old boy from Norway. Charges against Jon Johansen were dismissed in January, 2003.
